Booking and payment

1. The booking form must be completed and returned to bookings@yemayagrenadacharters.com.
2. Full payment for the charter should be made to Moorsafe Group Ltd. to secure the booking. In all cases, full payment for the charter must be received by Moorsafe Group Ltd. before any charter can commence.
3. Any damages, other than navigation-related damages, to the vessel or its gear and equipment caused by the Charterer or their guests are the responsibility of the Charterer.
Cancellation
1. If the Charterer cancels the Charter and/or Catering within 48 hours of the Charter, a fee equivalent to 100% of the full Charter costs will apply.
2. Yemaya reserves the right to cancel a Charter for any reason beyond Yemaya’s control, including weather conditions. In the event of such cancellation, Yemaya shall immediately notify the Charterer and offer alternative dates. If an alternative date cannot be agreed upon, the Charterer will be entitled to a full refund.
3. No liability is accepted for any costs or expenses incurred by the Charterer if Yemaya cancels.
Yemaya Obligations
1. Yemaya will exercise all reasonable care to ensure that any boat and equipment it charters is in every respect in good order.
2. Yemaya will use its best endeavours to deliver the vessel to the Charterer at the agreed time and place. If the yacht is not available at the agreed time and place, a pro-rata refund will be made for the delay. If the delay exceeds 50% of the charter period, the Charterer will be entitled to a full refund. No liability is accepted for any costs or expenses incurred by the Charterer in this event.
3. Yemaya will arrange the additional services indicated on the booking form and ensure that a representative is contactable for advice and assistance during the Charter period.
4. Any skippered yacht chartered by Yemaya will be approved for charter under the MCA Code of Practice for Small Commercial Vessels.
5. Any skippered yacht chartered by Yemaya will be insured for its full value, with third-party liability cover of no less than US$1,000,000. This insurance does not cover the loss of personal belongings.
6. Individual clients are not insured by Yemaya for loss of life or personal injury while onboard or near the insured vessel. In your own interests, you are advised to carry adequate personal accident cover.
Charterer Obligations
1. The Charterer accepts that the skipper’s decision is final on board.
2. The Charterer accepts that, while every effort will be made to put to sea, no boat will leave the harbour if, in the skipper’s opinion, weather or other conditions make it imprudent to do so. The Charterer accepts that, while every effort will be made to reach a preferred destination, this may not always be possible.
3. The Charterer is liable for damage to a yacht or its equipment directly attributable to the Charterer or any member of their party, except where the damage is due to the Charterer or a party member acting under the skipper’s instruction.
4. The Charterer will limit their party to no more than the number allowed on board the yacht specified at booking, and in any case no more than 10 people.
